
If you keep up with news about same sex marriage, you must know by now that the California Supreme Court upheld the constitutionality of the state constitution by upholding Proposition 8. This is good news for constitutionalists, like me. The decision, however, left intact the same sex marriages performed in California when the same court decided to throw out California's marriage definition law. From the LA Times:
The decision virtually ensures another fight at the ballot box over marriage rights for gays. Gay rights activists say they may ask voters to repeal the marriage ban as early as next year, and opponents have pledged to fight any such effort. Proposition 8 passed with 52% of the vote.Yes indeed, the fight will go on as gay activists continue to chip away at the foundations of our society - marriage and family.
Apart from the state-to-state attacks, the next step will be for Obama to try and get DOMA rescinded by the SCOTUS. He may wait on this for a few years until he makes another lame appointment to the SCOTUS who is also reasonably "empathetic" to failed liberal policies. The pro-same sex marriage folks will push for that day by picking bit by bit at the states where there is no constitutional definition of marriage to get in the way of the gay political agenda. But the folks at the top of the ladder - folks like Tim Gill - understand that their "cause" cannot stand up at the Supreme Court level just yet. So the gay activist leaders will bide their time and pick away at the institution bit by bit until they feel they've got a chance to win on the federal level.
